Terms of Use

1. Parties and Scope These Terms of Use set the rules for using the website https://www.herbaltox.com and related services (the "Site") operated by Herbaltox Gıda Limited Şirketi ("we") between us and everyone who visits or uses the Site ("user"). By using the Site you accept these terms; if you do not accept them, please do not use the Site. These terms govern general use of the Site. When you buy a product, the sale itself — including the right of withdrawal, delivery, returns and consumer rights — is governed by the Distance Sales Contract and the Pre-Contractual Information Form you accept with the order and by the Return and Withdrawal Policy; these terms do not replace those texts. How your personal data are processed is explained in the Privacy Policy and the Personal Data Processing Notice. 2. The Service The Site is an e-commerce service where products are presented, listed and can be ordered online. On the Site you can browse products, build a basket, place orders, track the status of your orders and contact us. Where the Site offers additional services such as membership or a newsletter, these terms apply to them as well. 3. Creating an Account Some services may require an account; you can also order without registering. When creating an account you agree to give accurate, current and complete information, to keep your password secret and that you are responsible for activity in your account. Tell us immediately if you notice unauthorised use of your account. If you sign in with a third-party account (for example with Google), that service's own terms also apply. You must be at least 18 years old, or use the Site under the supervision of a parent or guardian, to create an account. 4. User Obligations You agree to use the Site in accordance with the law, these terms and good faith; that the information you give is accurate; and to respect the rights of others. You are responsible for reviews, ratings, messages and similar content you send through the Site. 5. Prohibited Uses You may not use the Site to: - publish unlawful, misleading or offensive content or content that infringes the rights of others; - act on behalf of another person or under a false identity, or use another person's payment instrument without permission; - attempt to bypass the Site's security, gain unauthorised access to systems or spread malicious software; - crawl, overload or disrupt the Site with automated tools beyond normal use; - copy, reproduce or commercially use content without permission; - abuse campaigns and discounts. If these rules are breached we may take the measures in section 11 and exercise our legal rights. 6. Products and Seller Information The seller is Herbaltox Gıda Limited Şirketi (address: Atatürk Mahallesi İrfan Sokak No:10/A, 34764 Ümraniye, İstanbul, TR; tax office / tax number: Ümraniye / 4611180643; MERSIS: 0461118064300001). We take care to keep product descriptions, photos, prices and stock information accurate; small differences in colour and appearance may occur because of screen settings and similar reasons. If an obvious price or stock error is noticed, we contact you before confirming the order. Where the Site also offers products of other sellers, the seller is stated separately on each such product. 7. Orders and Payment Your order reaches us when you complete the payment step and confirm the order, and is confirmed by an order confirmation email. Prices are shown in the currency displayed at the time of the order, with taxes clearly stated as included or excluded. Payment is made by card, cash on delivery or other methods offered on the Site, through authorised payment institutions. The detailed rights and obligations regarding orders, delivery, withdrawal and returns are in the Distance Sales Contract, the Pre-Contractual Information Form and the Return and Withdrawal Policy. 8. Intellectual Property The design, logos, trademarks, texts, photos, software and other content on the Site belong to us or our licensors and are protected by intellectual property law. Except for personal, non-commercial use, they may not be copied, reproduced, distributed or modified without permission. For content you send to the Site, you grant us a free, perpetual licence to display it on the Site. 9. Third-Party Services The Site may use third-party services such as payment institutions, carriers, maps, analytics or sign-in services (for example Sign in with Google) and may contain links to other websites. These services are subject to their own terms and privacy policies; we are not responsible for their content or practices. 10. Changes to the Service We may change, temporarily suspend or end the Site's content, features and services with prior notice or, where unavoidable, without notice. Such changes do not affect your rights arising from completed orders. 11. Suspension and Termination We may temporarily suspend or close your account if you breach these terms, in case of suspected fraud or where the law requires. You may ask to close your account at any time; your data are then deleted in line with the Privacy Policy, except for the records the law requires us to keep. Suspension or termination does not take away your consumer rights arising from completed orders. 12. Liability We take reasonable care to provide the Site without interruption or error; however, to the extent permitted by law, we are not liable for interruptions caused by maintenance, faults, problems with third-party services or reasons beyond our control. This section does not limit consumers' statutory rights or our liability for intent or gross negligence. 13. Force Majeure The parties are not liable where obligations cannot be performed or are delayed because of events beyond their control, such as natural disasters, epidemics, war, strikes, infrastructure or power outages, cyber attacks or decisions of public authorities; obligations are suspended for the duration of the force majeure. 14. Governing Law These terms are governed by the laws of the Republic of Türkiye. For sales to consumers resident abroad, the mandatory consumer-protection rules of the law of the consumer's residence remain applicable. 15. Disputes In a dispute, we kindly ask you to contact us first at info@herbaltox.com. For disputes arising from consumer transactions, you may apply, within the monetary limits set each year by the Turkish Ministry of Trade, to the Consumer Arbitration Committee where you reside or where the transaction took place, and, above those limits, to the Consumer Courts. For disputes with users who are not consumers, the courts and enforcement offices of the place of our registered office have jurisdiction. 16. Changes to These Terms We may update these terms when necessary. The current version is always published on this page and applies from its publication; we announce important changes on the Site or by email to your registered address. Orders already placed are governed by the texts you accepted at the time of the order. 17.
