5.2 Shipped products are sent by the SELLER's contracted carrier to the delivery address the BUYER gave. The SELLER is responsible for loss and damage until the product is delivered.
5.3 You are advised to check the parcel on delivery and to have the carrier draw up a report for damaged parcels; the absence of a report does not take away your statutory rights regarding defective goods.
6. RIGHT OF WITHDRAWAL
6.1 The BUYER may withdraw from the contract within 14 days from receipt of the goods, without giving any reason and without paying any penalty. The statutory withdrawal period is fourteen days.
6.2 The period begins on the day the product is delivered to the BUYER or to a third party the BUYER designated; for orders whose products are delivered separately, on the day the last product is received. The BUYER may also withdraw before delivery.
6.3 To withdraw, it is sufficient to send the SELLER a clear statement before the period ends: by email to info@herbaltox.com, to the KEP address herbaltoxgida@hs01.kep.tr, in writing to Atatürk Mahallesi İrfan Sokak No:10/A, 34764 Ümraniye, İstanbul, TR, or through the order or returns page on the Site. You may use the model withdrawal notice in the Return and Withdrawal Policy.
6.4 All payments, delivery charges included, are refunded within fourteen days at the latest from the day the notice of withdrawal reaches the SELLER, in a way suited to the payment instrument used, in one go and without cost to the BUYER.
7. PRODUCTS EXCLUDED FROM WITHDRAWAL
Under Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to, in particular:
- products made to the BUYER's specifications, personalised or altered at the BUYER's request,
- products that deteriorate rapidly or may pass their expiry date,
- products whose packaging, tape, seal or wrapping has been opened after delivery and which are not suitable for return for health or hygiene reasons (for example opened food, cosmetics and personal care products),
- products that, after delivery, are by their nature inseparably mixed with other items,
- opened books, digital content and computer consumables,
- newspapers, magazines and other periodicals outside a subscription,
- services performed instantly in electronic form and intangible goods delivered instantly,
- products whose price depends on fluctuations in the financial markets outside the SELLER's control.
Products in these categories are marked on their product page. These exceptions do not affect the BUYER's statutory rights if the product is defective.
8. RETURN PROCEDURE AND COSTS
8.1 A BUYER who withdraws sends the product back to the SELLER within 10 days of sending the notice of withdrawal, where possible with its invoice, accessories and any free gifts.
8.2 Return shipping is paid by the SELLER when the product is sent with the carrier the SELLER designates in its reply to the notice of withdrawal and in the Return and Withdrawal Policy. Contracted return carrier: the carrier the seller names in its reply to the notice of withdrawal. If the SELLER designates no carrier for returns, no return cost is charged to the BUYER either; if the designated carrier has no branch where the BUYER is located, the product is collected from the BUYER at no extra cost.
8.3 The BUYER is not responsible for changes or deterioration resulting from use in line with the product's operation, technical specifications and instructions for use during the withdrawal period, but is liable for loss of value caused by use contrary to them.
9. DEFECTIVE GOODS AND WARRANTY
If the product is defective, the BUYER may, under Article 11 of Law No. 6502, choose to withdraw from the contract, ask for a price reduction proportionate to the defect, ask for free repair or, where possible, ask for replacement with a defect-free equivalent. Free repair and replacement are carried out within 30 working days at the latest. Claims for defects are time-barred two years after delivery. For products sold with a warranty certificate, the warranty terms are stated in the certificate.
10. COMPLAINTS AND DISPUTE RESOLUTION
10.1 You can reach the SELLER with complaints and requests through the phone, email, KEP and postal addresses in section 1.
10.2 In a dispute, the BUYER may apply, within the monetary limits announced each year by the Turkish Ministry of Trade, to the Consumer Arbitration Committee where the product was purchased or where the BUYER resides, and, above those limits, to the Consumer Court. Before filing a case with the Consumer Court, applying to a mediator is required in the cases provided for by law. Applications to arbitration committees can also be made through the Consumer Information System (TÜBİS) on the e-Government Gateway (e-Devlet).
